Will my ex-husbands divorce effect my child support payments?
Full Question:
I have a child with my ex-husband and my ex-husband is currently paying child support. He is remarried and has 2 more children with his current wife. I just found out his current wife is serving him divorce papers. I am worried about this affecting the child support I am receiving. My ex-husband is always behind with paying but eventually gets caught up. Should I worry that my son's child support will be lowered or somehow effected now that he will need to pay child support on his other two children?

Answer:
The child support would not be automatically lowered. It would take a court action or agreement with you approved by the court. Whether a court would lower it would depend on all the factors the court looks at in determining the amount of support. Since he has other children he could now have other obligations that the court could consider but that would only be one factor.
