How do I help my son get out of jail for non-payment of child support?
Full Question:
My granddaughter is 10 and I just found out she is living with her mothers sister for 2 years in Texas. My son has paid child support (although he is behind ) and has not been allowed to see her very often, sometimes it was 4 years at a time. The mother moved around and changed her number quite often. My son was picked up because he was behind on support and is in jail for 2 months. He wont be released unless he bonds out @ $2500. He has a job but it does not pay what he was making at the time they set child support. He tried numerous times to get them to lower it but they say he has to have a lawyer. He doesn't have enough for child support let alone enough for a lawyer! So, the back child support has become a large sum. Will a judge see this and hold her responsible for her actions? What are his chances of lowering the amount of the back support to fit his income?

I'm unable to say how a judge will view a matter. Generally, a person may have support modified based upon a significant change of circumstances, but will still owe the amounts due prior to modification.
