What would be real property in an estate?
Full Question:
This question is for the County of Gloucester, State of New Jersey. What exactly does "contents" mean in a Will when it reads "all of my real property and contents thereof"? This was left to my father's second wife (of only 2 years) (he was married to my mother for 42 years). For his 4 children it says "all of my estate, the rest, residue and remainder thereof, of every nature and description, whether "real", "personal" or mixed and wheresoever situate and whether acquired before or after the execution of this will . . . ." I know real property is the house, but what exactly is contents. He had personal items, etc. I am just confused to what exactly the second wife gets and what exactly the children get because she is NOT cooperating, whatsoever.

Answer:
The word "contents" is broad and could mean different things to different people. Thus, if there is a dispute, the court could be asked to resolve the issue. For example, contents could mean everything in the home such as funiture, as well as his personal property like jewerly, or on the other hand the jewerly might not be considered contents. Also what if he had stock or other things in the house? These I would argue are not contents. Depending on what assets you are concerned about could govern what action you take. I suggest you contact a local attorney for assistance.
