What is needed if my mother passed away with no will and no assets?

My mom passed away on 11/9/06. She lived with me. I am the second oldest child. I had medical power of attorney. She has no will. She has no assets (only debt)- No jewelry, no home, no car, only the clothes in her closet. She had a 10k life insurance policy. My husband is the beneficiary and is using 8k of that for her burial expenses. She leased a car and they want me to file with probate court. What should I do?

Answer:
I presume that the they you are referring to is the person or company who leased the car to your mother. You are under no duty to open an estate. The creditors can open one if they wish.
