States and local governments generally have the power to provide for waste collection under the police powers of the state to provide health and welfare for its people. Under Colorado Revised Statute Section 32-7-111, a town is authorized to make a designation of services for waste collection, subject to local authorization as provided in section 32-7-112, by local governing bodies, by resolution, or the people, by petition, or the service authority organizational commission. Colorado Revised Statute Section 32-7-112 provides for the voters to approve any taxes needed for the service. Any needed taxes for the service must be passed by a majority of the eligible electors voting thereon in each county within the service authority.
