Who Owns a Shared Wall in a Condominium?
Full Question:
We are an end unit of 3 houses; the common wall of our bedrooms extends up and becomes the sole wall of their 2nd story and also continues down becoming one wall of our courtyard. Is that courtyard wall their wall or a common wall?

According to California statutes, unless the declaration or condominium plan, if any exists, otherwise provides, if walls, floors, or ceilings are designated as boundaries of a separate interest, the interior surfaces of the perimeter walls, floors, ceilings, windows, doors, and outlets located within the separate interest are part of the separate interest and any other portions of the walls, floors, or ceilings are part of the common areas.
