Academic codes of conduct aim to support educational goals and be in line with criminal and civil laws. Sometimes the court has to interpret disputes about the legality of the code. Educators have to manage students' behavior while respecting their constitutional rights, such as rights to privacy, just cause, and due process. When criminal acts in schools involve law enforcement, certain subjects, conflicts, and events may come before the courts. Some cases involve the application of Fourteenth Amendment protections to students as these individuals are subjected to school regulations. The courts sometimes exercise academic abstention to defer to the school's internal procedures in academic matters, such as discipline, employment, and other issues. It is applicable in the context of colleges and universities.
A public officer is a person who acts on behalf of a public employer. Oregon statutes define a public employer in the context of the Public Employees Retirement System as follows: "Public employer" means the state, one of its agencies, any city, county, or municipal or public corporation, any political subdivision of the state or any instrumentality thereof, or an agency created by one or more such governmental organizations to provide governmental services. For purposes of this chapter, such agency created by one or more governmental organizations is a governmental instrumentality and a legal entity with power to enter into contracts, hold property and sue and be sued.
