An expungement is the process of legally destroying, obliterating or striking
out records or information in files, computers and other depositories relating
to criminal charges.
In Alabama, state criminal records of arrests not leading to conviction can be
sealed (including expunged, erased, or purged) where the person is not
charged or is cleared. Ala. Code § 41-9-625. The record is removed from
the computer database, and it is as if the individual never had a record.
The main problem with arrest records not being expunged is that so many
employment applications ask if the applicant has ever been arrested.
