Answer:
There is no specific age requirement, but age may be a factor in the weight given to the child's wishes. Custody of minor children of the marriage will be determined according to the child's best interest. Factors the court will consider in determining the best interests of the child include:
1. The wishes of the child's parents
2. The wishes of the child
3. The child's interaction and interrelationship with parents, siblings and any other person who may significantly affect the child's best interest
4. The child's adjustment to home, school and community
5. The mental and physical health of all involved
6. Which parent is more likely to honor and facilitate court-approved parenting time rights or visitation and companionship rights
7. Whether either parent has failed to make all child support payments, including arrearages
8. Whether either parent has been convicted of a criminal offense which resulted in the child being an abused or neglected child
9. Whether the residential parent has continuously and willfully denied the other parent's right to parenting time in accordance with a court order
10. Whether either parent has established a residence or is planning to establish a residence outside of the State of Ohio. § 3109.04
