How Do I Know My Wife Dismissed the Divorce Petition?
Full Question:
My wife has filed for divorce _30 days ago and now has decided that she want to work it out and wants to cancel the divorce. What do I need to see in order to know that the divorce has actually been canceled? I'm a little leary that she is just trying to pass time to win the default judgement because I have not filed an answer to the summons.

Answer:
When a pleading is filed, the opposing party typically must be served with a copy. If a motion of voluntary dismissal is filed in a divorce case, a certificate of service is attached, to prove a copy has been sent to the opposing party. When the motion for dismissal is filed, it will be entered into the court's docket system. If an order of dismissal is later granted, the order of dismissal will also be noted in the court docket. I suggest you call the clerk of courts where the divorce was filed to inquire about any such motions or orders if you have not received a copy.
