How do I protect my family from CPS?
Full Question:
What are my rights against CPS (Child Protection Services) harrassing me and my family in Texas, and we moved and it has followed me to Arkansas. I have already complied with the CPS long ago over the same exact issue and aligations. I proved that who ever called (they will not tell me) was wrong! And each time (3) the CPS worker that comes to see me as well as pull each of my children from class and drill them with questions about things that can curupt a child if they are not exsposed to it, and mine were not exsposed to the details of hard
drugs OR the manufacturing of illegal drugs! Which these are the things that these people chose to ask my children about without my permission or knowledge two different times! The case in Texas was dismissed, due to no evidince at all proving the alligations that were made were true! And we move to ARKANSAS and we have not been here 2 weeks and lo and behold, today
two ladies show up at our childrens school (embarassment AGAIN!!) and at our house after they spoke to my kids. I want this to end!! What can we do?!?

Answer:
According to the court in Doe et al, v. Heck et al (No. 01-3648, 2003 US App. Lexis 7144), the investigative interview of a child by DPS constitutes a search and seizure. If the interview is conducted on private property without consent, a warrant, probable cause, or exigent circumstances, such an interview is an unreasonable search and seizureand violates the constitutional rights of the parent, child, and, perhaps the property owner.
