Can a Lawyer be Sued for Deceptive Trade Practices?
Full Question:
Answer:
It is possible, depending on the facts involved. Under the consumer protection section of the Texas Act, "Person" means an individual, partnership, corporation, association, or other group, however organized, therefore it applies to attorneys, since there is no exception for attorneys. The answer will depend on the circumstances involved. The legislation is intended to deal with "false, misleading, or deceptive acts or practices", and then says the act complained of must fall under one of the numbered situations. For example, one situation is where someone is accused of "representing that an agreement confers or involves rights, remedies, or obligations which it does not have or involve, or which are prohibited by law".
