What options do I have if I can no longer afford the restitution payment?
Full Question:
I got into trouble at my old job at Macy's. I was caught stealing product and gave it back and spent jail time for the act. It was the first time I was in trouble with the law. The made me sign a promissary note for restitition for a very large amount of money under the threat of further prosecution because I was suspected of selling some stolen product on ebay. I have no receipts for the products that were sold but they were not stolen. I am currently paying $445 a month to this dept store and since I recently divorced and have 2 small children and cannot afford this huge payment. What is my recourse?

Answer:
It may be possible to have debt discharged or reduced through bankruptcy. However, it depends on the characterization of the debt, as criminal restitution often isn't dischargeable. I suggest talking to an attorney or debt counselor.
