If a Foster Parent gives the child to the Parent without the Courts knowledge and the Parent dies, may the Foster Parents exercise their guardianship rights as foster Parents.

This would depend on all the facts of the particular case and the laws of the state. Generally, if the rights of the Foster Parents have not be terminated or expired by terms of the Court order, they could have rights. But if those rights are contested by someone else who claims the child, the Court would make the decision and may look with disfavor on the fact that the Foster Parents gave the child to the Parent without authority.
