Can my landlord charge court cost without going to court?

There was a notice sent out by my new landlord that stated that after the 5th of the month a late fee and a court fee of $64.00 will be added to the rent. If I pay my rent on the 7th, can he charge court cost without going to court?

A court fee isn't prohibited by MS state law. If the contract doesn't specify that the court fee is only charged in the event that the parties go to court, it may be a permissible contract term. Generally, parties are free to negotiate contract terms as long as they are not illegal nor unconscionable.
