Can they place a lien or judgement against her for mothers debt?
Full Question:
My 82 year old Mother was in a nursing facility last fall where all fees were not paid relating to her stay. She has Medicare and BC/BS. They had ask that we file for Medicaid after her release to assist. This is unusal. We never had this occur before.
Now, they are asking her to pay $9000.00 in fee for her stay and attorney's fees. They have filed a Motion for Summary Judgement.
My Mother does not have any property. She is on a small fixed income.
What can they do in the State of Florida with a summary judgement? Can they place a lien or judgement against her? If so, can they garnish her social security and/or retirement? I guess I want to know the best and worst case scenario.
Can they go after property that she or I may have?
They have also served me. I am her daughter and care giver.
Are there any papers I can file with the court to stop this process. She only has a small amount each month that she could pay, if that - toward this bill?

Answer:
Children don't inherit their parent's debts unless they created a co-signor/guarantor/surety/joint account relationship to the debt, so that the child's name is on the debt also, and it isn't a separate debt.
