Who gets the trust property if a beneficiary dies?

- If the beneficiary dies before the trustor of a trust the provisions of the trust generally control what happens to his share of the trust. They may lapse, go to other beneficiaries of the trust, to the estate, or other provision.
- If there are no provisions the share for the beneficiary usually go to the estate of the deceased beneficiary, or his or her children by what is referred to as representation.
