I have a 4 month old child and the father and I are not married and no longer together. Our fighting became physical and the verbal abuse is horrifying. I want to remove myself and my son by moving and starting over. Is it legal for my son and I to move to another state?

As long as there is no official order in effect requiring notice or permission, a person is free to relocate. Is his name on the birth certificates of the children as the father? If it is, he can sue for custody or visitation. If it is not, he has to first prove that he is the father of the children.
