In California on Oct 5, 2001, Governor Davis made California the first state to set out new laws to regulate destructive fungus and mold. The law directs the California Department of Health Services (DHS) by July 1, 2003 to develop and adopt standards for mold exposure limits for mold in indoor environments. The law will also require landlords and owners of both commercial and residential property to disclose to prospective buyers and tenants, the presence of toxic mold that exceed the new law exposure limits. The law does not require landlords to sample, inspect or test for levels of such toxins, however case law holds landlords liable even if they don't.
