In the state of South Carolina if two names are listed on a check one on top of the other is the check considered and or or?

Answer:

If there is not an AND such as John Doe and Jane Doe, either party can sign. It is not wise to use AND for couples. Instead use OR. Having both names on the check on top of another is common and should not be a problem for one account holder named signing the check.
