Can we agree on all the terms of custody and visitation without involvement of the court?
Full Question:
We are Man and Woman who were engaged for 6 years. We have decided to split up. We have 3 small childeren together. We want things to be as easy as possible. The mother will be the custodial parent. The Father can see his childeren whenever he wants. The mother and childeren will stay in the 4 bedroom condo that is owned under the fathers name. The father will pay the mortgage on the Condo and the association dues every month for a total of $1,294 per month. The Father will also pay for the childs medical and dental insurance for a monthly total of $500 per month. The Father will take the childeren approx 25% of the time. This is completley agreed apon by both of us. We need to know what form we need to fill out so we can get this agreement between us on paper and on a form that would hold up in court if it ever needed to. This way both parties are protected. Neither of us want to go through the court system if we dont have to and we do not want child support involved. Is there such a form or forms? If so, what one do we use?

Answer:
Since you are not married, any agreement you make as parents for custody and visitation will not be enforcable without court approval.
The court will also make orders regarding custody, child support and visitation and require the parents to attend parenting education. The court will ask for a parenting plan from you and your spouse. If the court agrees that your plan on these matters is in the best interest of the children, it will make the plan into a court order. Unfortunately also, child support cannot be waived by either party.
