Have I lost my home or do I have rights?
Full Question:
I was under a repayment plan contract with my mortgage company to pay a past due balance and current payment, the contract was signed, dated and fax on 1/29/07, it was also faxed on 1/30/07 along with the payment receipts for the downpayment of the contract. No payment was asked of for feb and the next payment was requested march 15 07, the mortgage company closed out our loan on Feb 1, 07 after receiving the payments and foreclosed on our property anyway, my home was auctioned and sold on March 3, 07 without any notice to us. I later found out April 25, 07 and have been in contact with not only the mortgage company, but also with FHA/HUD and after HUD spoke with the mortgage company they told them to rescind the loan and qualify us for a loss litigation per HUD guidelines. The mortgage company then contacted me again and stated I do not qualify for anything and snickered on the phone and stated there is nothing they can do. My mortgage company breeched my contract after received my initial down payment, do I have any rights or Did I basically lose my home and there is nothing I can do about it?
