How Does Remarriage Affect a QDRO?
Full Question:
I have been divorced from my ex for the last 15 years, and she remarried 5years ago and she is still getting half of my Postal Pension to this day. Between her and her husband, they make a combined salary in excess of $100,00.00 a year and they also own 6 duplexes and at least 4 plots of land. Do i have a leg to stand on when i try to stop her from getting any monies from the Postal Pension, and will she be ordered to reimburse me said monies which amounts to $40,000.00 over the past 5 years and if i am successful in this case, can i ask for interest on top of the money that i feel is rightfully mine. I forgot to tell you that i overpaid her $2,600.00 in alimony because i forgot that the alimony should have stopped once she remarried. I would appreciate your input, whether it be good or bad.
