Is it safe for me to open a small estate in my husbands' name due to medical malpractice suit?
Before my husband passed away, we had signed a contract with a large law firm in Maryland and have a medical malpractice suit ongoing at the present time. My husband just passed away the 15th of February and the law firm wants me to open a small estate in my husbands' name. My question is in regards to the need to probate a will in Texas. My mother is close to death and she currently has no assets or debt. Recently my brother died having no will. My sister and I as his only next of kin. Our parents both predeceased him. He never married nor had any children. How do we file for his possessions under the OCR Title 21 for Intestate Decedent? He had only personal effects, a vehicle ($2500), and less than $20,000 in the bank.
