If a man is married to a woman that he doesn't live with and has a will leaving his property, that is only in his name, to someone other than his wife, does she automatically get his property?

My mother lives in California. Her brother recently passed away. The state is now involved in settling his affairs; however, they want my mother to locate possible heirs to what remains of my uncle's estate. Is that not THEIR job? Also, why are they seeking out nieces and nephews? Shouldn't his remaining assets go to immediate family only (i.e., surviving brothers & sisters)?

My father passed away over a year ago, and my mother in the past month. She still had him listed as the beneficiary on her policy. Does the insurance company have to accept an affidavit of heirship (it is only a 30,000 dollar policy) or can my brother and I be forced into probate court. There is no other real property to be divided.
